Terms of Service

These terms govern your use of the Delvia app ("Delvia Health" on Google Play), operated by Simak Labs (support@simak.ai). By creating an account you agree to them.

1. What Delvia is — and is not

Delvia is an informational and organizational tool: it stores the health information you choose to record and uses AI to explain and organize it in plain language.

Delvia is not a medical device and does not provide medical advice. It does not diagnose, treat, cure, or prevent any medical condition, and it never replaces the judgment of a qualified healthcare professional. Always consult your doctor before making medical decisions. If you may be experiencing a medical emergency, contact your local emergency services immediately.

2. AI-generated content

  • Explanations in the app are generated by AI and may be incomplete or wrong. Verify anything important with your doctor.
  • Every AI response carries a "not medical advice" notice and a Report action. We review reports and use them to improve our safeguards.
  • You must not attempt to use Delvia to obtain diagnosis, treatment, or prescription decisions.

3. Your account

  • You must be 18 or older.
  • Keep your credentials confidential; you are responsible for activity on your account.
  • Only upload health information that is yours, or that you are clearly authorized to manage.
  • Provide accurate information — the quality of what Delvia organizes depends on it.

4. Credits and Delvia Plus

  • New accounts receive a one-time grant of free credits. AI actions (such as sending a message for analysis) consume credits at the rates shown in the app.
  • Delvia Plus is a subscription (monthly or annual) that includes a monthly credit allowance. The allowance refreshes each month on both plans; unused credits do not roll over and have no cash value.
  • Subscriptions are billed through Google Play and renew automatically until you cancel in your Google Play subscriptions. Deleting the app or your account does not cancel the subscription.
  • Refunds are handled under Google Play's refund policy.
  • We may adjust pricing or credit rates prospectively; changes never apply retroactively to time you have already paid for.

5. Acceptable use

You agree not to misuse the service — including attempting to breach its security, probing other users' data, reverse-engineering the app, scraping, reselling access, sending unlawful content, or using automated tools to exhaust the AI service.

6. Your data

Your health data belongs to you. How we handle it is described in the Privacy Policy, which is part of these terms. You can export your data or delete your account — in the app or via the account deletion page — at any time.

7. Termination

You can stop using Delvia and delete your account whenever you like. We may suspend or terminate accounts that violate these terms or abuse the service; where reasonable, we will warn you first.

8. Disclaimers and liability

The service is provided "as is". To the maximum extent permitted by law, Simak Labs is not liable for indirect or consequential damages, or for decisions made in reliance on AI-generated content. Nothing in these terms limits liability that cannot lawfully be limited, or your statutory consumer rights.

9. Changes

We may update these terms; material changes will be announced in the app. Continuing to use Delvia after a change means you accept the updated terms. The current version always lives at this address.
